AmazingTrans
Hi everybody, I am on a H1-B and my wife on a H4 expired visa stamp. We have our extended I-797 form that shows our visa has extended till next year. We are going to leave 4 days times. I realllyyy want to confirm if we are good on the Automatic Revalidation Rule (AVR), because according to my lawyer, he said we are good to go and guaranteed that we will be able to re-enter. But after reading so many forums, and some links, I would like someone to clarify for me that the H-status is not legally alright to travel to Caribbean. Here are some original links on AVR (Which I am also confident that H status visa are able to enter, exit Canada, Mexico, and Caribbean as long as we abide by the certain rules.) For those who thinks and are experienced that the H-visa is not valid : (Please. If you could point out the exact location that says H visa is not valid on Caribbean that would be great) Telegram: Travel State http://travel.state.gov/visa/laws/telegrams/telegrams_1441.html Code Of Federal Regulations http://www.usimmlaw.com/VisaRevalidationReg_FAM.pdf Federal Government http://www.gpo.gov/fdsys/pkg/FR-2002-03-07/pdf/02-5325.pdf http://www.gpo.gov/fdsys/pkg/FR-2002-03-07/html/02-5325.htm Cheers, AmazingTrans Link to comment
