jan7th Posted December 17, 2012 Report Posted December 17, 2012 Hello Friends, My H1-B start date was Nov 1st but my opt is valid till Jan'16th so my employer ran my payroll as opt for Nov month. Please suggest if it will be a problem for my visa stamping. Please Please respond to this as I am worried. Thanks for your response.
usalife Posted December 17, 2012 Report Posted December 17, 2012 Your status will be changed to H1 from NOV 1st. OPT will be automatically cancelled once your H1 start date has reached. So be prepared to face that question.

usalife Posted December 17, 2012 Report Posted December 17, 2012 It depends on the amount mentioned in the LCA when your H1 was filed. On H1 your pay should not be less than LCA amount. If on NOV payroll you got less pay ran than your LCA amount it is a violation of labour law OPT payroll will NOT include medicare and ssn taxes so obviously in your NOV month payroll you did not pay that. Ask your empoyer and your CPA for corrections.
