In case I decide to come back to US in future when I go to India, can an employer apply for h-1b any time during the year ? I am on H-1b since Oct 2010. I have US master's degree. Attorney_10 Posted December 17, 2012 Report Share Posted December 17, 2012 Generally, an individual is eligible for six years of H1B time and only counted against the numerical H1B cap once during the initial six years. Generally, time spent abroad after being counted against the cap does not count towards the six years. If an individual spends at least one full year abroad, s/he has the option to either be counted against the cap again for a new six year period of H1B time or use the time remaining from the original six years.
