tomcruise Posted December 13, 2012 Report Posted December 13, 2012 Hi, i have a very unusual situation and wanted to seek if anyone else has/d same problem if so how you handled it. Here are details 1. H1 B extension (second third year) applied from Company A which was approved in Jan 2011 for 3 years. 2. April 2012 received EAD as my priority date was current 3. June transferred my H1 B to new employer, AC21 invoked 4. November received approval for H1 B transfer 5. December received email that my original approved H1 B extension was denied. Not sure why USCIS would do this?? Was i out of status for all the time in 2011-2012, will my current approved H1b visa with new employer aslo be denied?? Please let me know
metroguy Posted December 13, 2012 Report Posted December 13, 2012 You got ur h1b transfer done right. if yes, then you need not have to worry. H1B tranfer and H1B extension are two things. A person can hold multiple H1B's at a point of time and each H1B has it own path.
t75 Posted December 15, 2012 Report Posted December 15, 2012 But transfers are contingent upon earlier processing. Provide all info to your company's attorney for a review
