Hi,

I was on a H1-B until Sep,5 of this year,when i fot laid-off.Since my employer was kind enough to inform me before my last day, i applied for cos to f1.i got approved for the Jan semester but classes don't start until January 22.So my f1 is valid from 12/23/12.In the interim, God was good to me and I got a job offer.My ,question, is do I come under cap gap?

Cap-gap is only for people who finished their degree before Oct. 1 when the H1 starts.

It absolutely does NOT apply to your case.

If OP takes up the job without going to school, then its violating the F1 rules.

But I guess here, OP has to go to school as he/she doesn't have any other option.
