newguyaustin Posted December 7, 2012 Report Posted December 7, 2012 I was recently let go from a company as part of layoffs at the firm. In the midst of winding up and heading back I've managed to find a job. It took me 10 calendar days of my last payday to get the offer. I would like to know if the new company can file for a H1b transfer without me having to leave the US. I have a gap of 10 calendar days since my last paycheck. Or do I need to leave and re-enter via consulate processing? Thanks
wiweq Posted December 7, 2012 Report Posted December 7, 2012 Let your new company file your H1b. 10 days is something USCIS can ignore. Cross your fingers an wait for the result. If they ask you for CP, leave the USA to get the visa. All the best.
