ramsi_ece Posted December 5, 2012 Report Posted December 5, 2012 I am in US on H1B. My spouse & child are on H4, and are currently in India. Our Visa (for all of us) is expiring by April Mid. Also, my I-94 is expiring by Apr mid. My company is filing for H1B visa extension. 1. Can I stay in the USA beyond April, if my visa extension is approved? and Even if my I-94 expires? 2. Assuming I am in the US, and the visa extension is approved; Can my spouse and child travel to US by Apr 1st, with the copies of H1 extension papers? Can they stay in the US for 2 months, with the current stamped visa expiring by Apr mid? Thanks for clarifying

Can they stay in the US for 2 months, with the current stamped visa expiring by Apr mid? 1.Yes, once your extension is approved you will receive new I94 2.In order to enter into US, your family needs valid visa.They can enter into US before their visa expires.
