COS from H4 to F1 while my husband's H1 is getting transferred.

Hi,

I am in a confusing situation right now. My husband has his H1 upto Dec 25 2014. But, unfortunately he got laid off from his company yesterday i.e 12/3/2012. And, has applied for a H1 transfer meanwhile to retain his H1 status. Meanwhile since i wanted to do my masters I applied for a COS from H4 to F1 based on his H1 with his earlier employer.

I want to know,

1) What will happen to the COS that i had applied, will it be processed successfuly or not?

2) Does the COS from H4 to F1 become invalid automatically since my husband's H1 becomes technically invalid from today ?

Most likely ure COS to F1 should not be affected by his status change becasue it would be independent of his H1 status. Secondly you also put in your COS earleir than when he was laid off. And again if there is any problem it would come up only if and when his previous comapny informs USCIS of the layoff especially if he is shown to be your financial sponsor. So keep ure fingers crossed.
