Critical, please reply...I 797 expired still valid I94, what are the chances to get it through

I have a critical case My I 797 expired on 4th July 2011, However my I 94 is valid till 14th July. My employer filed my extension on 7th July 2011.

What are the options I have. My LCA is still valid till next year. My attorney is saying there could be changce for Overseas approval.

Can anybody give me feedback on this, please if they came across same case.
