H1B renewal - Petition expired Sep/2008

Hi, My H1B petition expired in Sep/2008 (stamping on Feb/2006 and expire on Sep/2008). I used this H1B for 7 months in 2007. Then I went to India in 2007 end and there in India for 1.5 years. Later my company processed L1B in 2009 then I came back to US in 2009 and in US since then (3 years in US now).

Now I wish to understan d if my expired H1B can be renewed without waiting for the 2013 cap to open? Could you please advice if the petition can be renwed even it expiered in Sep/2008 (stamping on Feb/2006 and expire on Sep/2008). I have 2.5 years remaining in my L1B.
