h1bCOSQuestion Posted December 2, 2012 Report Share Posted December 2, 2012 I have H1B approval with cos from company B starting from Dec 2012.I want to continue with L1B with my current company.Qualified attorney from my company is confident that I can do so and it will not put me out of status beyond Dec COS effective date until I join the H1B company.This is somewhat a contradictory statement from what I gathered from internet.Can somebody please throw some light on it? JoeF Posted December 3, 2012 Report Share Posted December 3, 2012 You are on H1 from the start date listed on the I-94 that came with the COS. If you don't join the company that sponsored the H1`, you are out of status, i.e., illegal. If your lawyer doesn't know that, get a better lawyer. Link to comment
CCR Posted December 3, 2012 Report Share Posted December 3, 2012 Joe is right... USCIS does not know where you are sitting, L1 in Chicago or H1 in Dallas, just to cite an example. They only know and care that no matter what status u entered on (L1 in ure case) the fact that you're H1 is valid from a certain date in Dec means that you are on that status from then on. So tell ure lawyer to re-enlist for law classes with specialization in immigration. Link to comment
