Employer A insists that I do contracting for a while but I'm yet to find a job. Now, can I join full time with another Employer B by transferring my H1B? I donot have any pay stubs from my previous Employer A Please let me know, Thanks
JoeF Posted November 28, 2012 Report Posted November 28, 2012 Your employer has to pay you, even if you are on bench without a project. That's the law, and the employer knows it.If y our employer doesn't want to pay you, file a complaint with DOL on form WH4. You are out of status, and you can not transfer without getting paid or having filed a WH4.

I donot have any pay stubs from my previous Employer A If you are not getting paid on H1 means, you are technically out of status. You need latest pay-stubs for H1 transfer. Pay-stub is the only document which says that you are getting paid.
