mborkar Posted November 27, 2012 Report Share Posted November 27, 2012 I am working in USA. I am holding H1B USA Visa and My Visa was expired in 2011 and then I got extension for next 3 years. Now my new I 94 is Expired Aug 2015. My company apply green card for me and my labor certification is approved and they filed 140.i am still waiting I140 status. My Question is can we (myself and my family ) travel to India and come back to USA. then what is the procedure should i follow? and how much chances to getting stamping US H1b visa for 2nd time.? shandan Posted November 28, 2012 Report Share Posted November 28, 2012 GC process is independent of our H1B unless you filed for i-485 there is nothing prohibiting you from traveling, as long as you have a valid visa to come back, you should be fine traveling. As far as stamping goes H1B is a dual intent visa and hence your GC process should not be any adverse effect on your H1B stamping. Link to comment
