harsha_g2 Posted November 22, 2012 Report Share Posted November 22, 2012 Hello, I have been approved of H1-B in the year 2007 (belongs to 2007 quota) and further to an additional query my visa has been stamped in 2008. I have never travelled to USA on H1-B and the visa got expired in 2010. I have few questions about invoking H1-B again: 1. If an employer is ready to sponsor - will my application be considered under the quota or is it quota exempted? 2. Since it is almost 6 years - if at all I go for visa stamping,will it be given for another year only?Or, is it eligible to be given for 3years? Any guidance/suggestion is highly appreciated. ALittleBitOfLuck Posted December 3, 2012 Report Share Posted December 3, 2012 The time you stayed on H1 in US will be counted. You can still use the 2-3 years which were spent in India. If an employer is ready to sponsor, you do not need to file again and it is exempt from the quota. Your quota was 2007 and it'll remain same. I have a similar case where my H1 was approved in 2008 but couldn't get it stamped bcoz of 221(g). Keep in touch so that we can share more info on this issue. Link to comment
