jinneebhat Posted November 20, 2012 Report Share Posted November 20, 2012 I read on murthy site that in case the labor is not applied before 365 days and there is a pending audit, one can change his/her status to L2(provided spouse on L1) AFTER 6 YR H1B COMPLETION and wait for labor audit to complete. and once approval is sought, one can apply back to H1b from L2 with COS without having to travel out of US However, when checkied on some other forums, they do not agree that above is possible.
