How can I proceed

My case:

PD for EB2: June 2007

Current situation: Used AC21 10 months ago and changed employer.Current employer filed an H1B as well based on previously approved I-140 (from GC process) which is valid for the next 3 years.

Now I want to switch this employer.

1 .Can I can use AC21 again or can I change without ac21 using just my ead

2. even if i wait till my gc can i change so immediately after I get a green card

what are my options ? pls advice.

1. You can use AC21 again. This has nothing to do with the use of EAD.

2. I would not do it.

Like you did before, you can still change employer & new employer has to file AC21. Just remember to change your address on USCIS if you move to different address. So, that you'll get GC on new address, whenever you get.

With this new employer, using AC 21,can I work on W2( hourly billings) instead of a salary? Will this have any repercussions? Let me know your thoughts please!!!

To qualify for AC21 the job should be full time (40 hours/week) and permanent (i.e. indefinite in nature).

I am planning to switch from my current company (which I had joined using AC21, BUT using H1B currently) to a new company in 2 weeks (where I'll be using my EAD and sending in another AC21).

With all the current predictions about the movement in dates, will my company change affect my GC process?
