epsatha
I need a clarification regarding H1B Transfer. Currently I'm with say employer A . My H1B is getting expired by Mar 2013 & my current employer is in the processing of filling my H1B extension (not filed yet & they may file within a month) Same time if I change to employer B, will it be a problem? Same time if employer A's extension application and employer B's Visa transfer application goes to USCIS, will it create any problem? Should I wait for the employer A's extension and then ask employer B to initiate the Visa transfer? or both can happen same time? Please advise me. Link to comment
krialta
Both are independent to each other, you could initiate both of them in parallel unless your I94 has not changed due to any travel. Link to comment
epsatha
What if my current employer (emp A) application reaches uscis after employer B? One of my friend told in this case it will overwrite. Is it true? Link to comment
krialta
Who ever employer you choose to work with, your stay would be based on petition expiry date of that employer. you have nothing to worry about. Act smart in opting the employer, leave rest to them. Link to comment
