rajiv460 Posted November 8, 2012 Report Share Posted November 8, 2012 Hi, My friend has applied H1B in April. He got an RFE after 4 months. He replied back to it but it got denied on last tuesday. His F1 VISA Ended in June 2012 and Cap Gap I-20 Ended on Oct 1 2012. What are his options now? I have heard about Motion To Reconsider(MTR). Would Applying for MTR work out for him? He is also looking for universities where he can join and continue his status. Is this possible as both his Visa and I-20 expired ? Link to comment

JoeF Posted November 8, 2012 Report Share Posted November 8, 2012 Universities have deadlines. People can not just apply and get into status there. It takes several months to get accepted at a university. And if he thinks about some fraud diploma mill, that would really kill his future in the US. An MTR also does not give a person any legal status. He will have to leave the country, and next time, he should look for a better employer. Link to comment
