H1 revocation Issue

My wife was working on H1 for her employer since last November and now while filing for her extension she is informed that her current H1 was revoked in last November itself due to a mistake/miscommunication from employer to USCIS.

Currently we have filed her change of status to approved H4 so that she can legally continue in USA.

So due to employer's mistake it seems her H1 visa status is now in revoked status and employer said that they have filed an extension with an additional letter informing USCIS about the mistake. They have not shared that letter with us and we really doubt extension for a revoked petition will work.

So can we sue employer for this mistake which has messed up my wife's career and her work status and will also affect my GC which is under process currently ? So can we sue employer for any financial compensation ?

Please advise.
