L1B Extn rejected and L2 Status Update

Hi,

My I94 expired on August 25,2012 and received RFE for my L1 B Extn during September last week. We provided all the docs, however it was denied Nov 1st. My wife is currently on L1B and would like to change my status as L2.

1. Can I change my status to L2 while I am in US?

2. Once I change my status to L2, as I already have SSN how long it will take to get EAD?

Please assist.

To apply for COS, you should have a current legal status. Since, your extension is denied, you are no longer in a legal status. Best option is to go back to your home country ASAP and get the Visa stamped.

In my personal experience, the EAD on L2 takes around 2-3 months of time.

An experienced attorney might be able to guide you better on this.
