In 2007 while I was in India my employer got my US H1-B petition and I also got my visa stamped. Currently, my visa and petition got expired in Oct 2010 and I didn’t use it for once to come to US. I am planning to move from Canada to US and wondering if there is a way that my petition can be extended with another employer “Y” in US. Please let me know the options available for me. One of my friends was mentioning that if I travel to US on a tourist visa and make an entry, the expired petition will also be opened up. Please let me know if it’s true ? Thanks-
krialta Posted November 2, 2012 Report Posted November 2, 2012 I would laugh at your friend. How does B2 tourist visa will open up your H1 petition? they are two different types of visas. Find a job and employer who could file cap-exempt for you. Once approved by USCIS, visa stamping and entry to USA.
