tummyroad63
I will be working in a new location in a different county close to my house. Have couple of questions, 1. If I work there for 2 months or less, do I need to file a new LCA or H1B amendment? 2. If I have to work there for more than 2 months, do I have to do H1B amendment or just new LCA? My employer has a office in this particular county and it is not a subcontracting job. Thank you in advance. Link to comment
krialta
It does not matter how many months, this is considered as change in terms and conditions of employment. One would have to file H1B amendment. help yourself - http://www.murthy.com/2012/09/07/h1b-amendment-requirement-for-change-in-job-location/ Link to comment
tummyroad63
krialta Please check out this Handbook from a lawyer's website http://www.***************.pdf USCIS might have changed its position on new LCA and H1B amendement, although it does not seem to be official USCIS policy. From Murthy's article, it does not appear that USCIS has changed its position on duration on temporary placement. It apperas that temporary placement for less than 60 days does not need new LCA.
