" A person changed H1B to H4 status(and had received the approval for H4 with I - 94 attached valid for 2 more years) and later applied for H1 after few months. USCIS sends NOID for additional documents and employer have to withdraw the H1B application as he no longer needed the employee. What happen to the already approved H4 ? Will the person automatically fall back to H4 status or should we have to reapply H4 petition again?". Thank you all.
krialta Posted November 1, 2012 Report Posted November 1, 2012 If employer withdraws, COS never happened from H4 to H1, so she continues on her H4.
