bonp Posted October 31, 2012 Report Share Posted October 31, 2012 Hi, Here is my scenario 2009 Completed Masters Degree in USA and started OPT April 2010, I received H1b Visa and worked till 2011 In June 2011 converted to F1 and did my MBA which is completing in DEC2012. F1 visa expiring on DEC2012 I have a company willing to sponsor my H1B However the quota for H1b for year 2011-12 is over. One Lawyer says that I can Port my H1B number from my previous H1B filling. Is it possible? What other options do I have? Urgent need help? Can I apply for OPT again? Link to comment
krialta Posted October 31, 2012 Report Share Posted October 31, 2012 Lawyers are more experienced, I do not see a reason why you do not believe them? Speak to your lawyer if you have questions. You could file cap-excempt with COS for your existing H1B if your employer is willing to without need to wait till next year cap. Link to comment

I sincerely doubt whether you could do that as USCIS have refined their interpretation of the portability clause. There is a possibility that your lawyer is not aware of this. Ask opinion of another lawyer before you initiate the process. Good luck and let me know what is the outcome of your process.
