samsonkiran Posted October 25, 2012 Report Share Posted October 25, 2012 Hi all, I recently transferred by H1B from Company A (current employer) to Company B & filed my resignation with Company A. Now the Company A (current employer) is asking me return the Form 1-797 to them. Is it OK to return the form I-797? Will this going to affect my proposed the GC process? Please advice. shandan Posted October 26, 2012 Report Share Posted October 26, 2012 You can make a copy of the I-797 for your records and return the original/first I-797 to the employer as by law it is theres to keep. But make sure you have your I-797 from the transfer approval, that also actually belongs with the new employer, all you need to have is the I-94 which is attached to the bottom of the I-797.
