How to Respond to 221 G - CLIENT LETTER

Received - 221 G – BLUE SLIP in Nov -2011 @ HYD Consulate on a CLIENT A – PROJECT A

After 11 months – HYD Consulate requested for CLIENT LETTER

Now CLIENT A – VENDOR A – not willing to give any letter ( even on old dates or letter of termination ) . Planning to submit the OLD WORK ORDER !

And expecting Visa Officer to ask – if there is NO PROJECT – why do u want to go back to US ?

So if I start attending interviews and get a new WORK ORDER – with CLIENT B – WITH OLD PETITION

  1. Do I need to get a new LCA ?
  2. Do I need to file any amendment from INDIA ? Or can it be filed from US ?
  3. What are the other precautions to be taken while responding to a 221-G Or RFE ?

1. It will be a new petition,so you need new LCA ( I am not sure whether it will cap exempt or not)

2.Your current petition is pending, so you cannot do any amendments to that petition. Only approved petitions can be amended

2. Make sure you have less no of layers between you and your employer.
