My new employer filed my H1B Transfer on Aug. 29, 2012 but not under premium processing as he could not get end-client letter. Now my employer terminated my employment saying my last working day with them was Oct. 18, 2012 and my H1B has not yet been approved. Can you please tell me what is my status right now? visaoct15 Posted October 23, 2012 Report Share Posted October 23, 2012 Your first H1 expired on July 31st and your new employer filed h1 on Aug 29, 2012? If that is the case then you might be out of status for the 30days gap in b/w.But it shouldn't be a big problem...once your h1gets approved you might need to go out of the country and get the visa stamped as your H1 approval may not have i-94.
