EAD and LLC/1099

Hello folks,

can someone tell me if I can work "on 1099" terms having EAD (and i-485 pending for over 180 days).

Sorry if the Q is vague.

Do I need to establish an LLC to be a 1099 worker? Can one do so on EAD?

You can work as a self-employed person using 1099.

No need to create an LLC. Self-employed basically means you run a one-person company with the company form just being a single owner.

LLCs and other company forms have way more administrative overhead.

For this One-Person company do we have to register this company or get some kind of registration to work on 1099 ?

If I travel and re-enter US, assuming I have my existing H1 job, can I enter on H1 status?

You use your SSN as taxpayer id. You need to get a business permit from your city, but that's it.

If you are working with the EAD as self-employed, you are not on H1 anymore. You would need AP to travel abroad.
