Vij4477 Posted October 18, 2012 Report Share Posted October 18, 2012 My employer filed my labor in EB2 this June but unfortunatley i got RFE on that, my employer has sent the documentation in a week, heard people saying it takes 4-5 months to get the confirmation if i get an RFE, current Labor Audit priority Date is in Feb 2012 and my H1B is expiring in Sep 2013. My Questions 1) I first came to US in Feb, since H1B period starts from Oct can i add those 4months to my H1B and extend my H1B validity till Jan 2014 without doing H1B transfer or should i have to do H1B transfer to get those 4 months ? 2) Should i change my employer and file my labor again. Since after 4-5 months " IF " my labor gets rejected i wont have time to file. Thanks for your time and valuble response. Link to comment
