H1-B filing by client working for consultant

Hello experts,

I am working for a company throgh a staffing agency. The comapny wants to file for my H1-B in April 2013. My question to you is that can my company file for my H1 even though I am working for a staffing agency in April.

who can pay nice amount ,does not create any issues when you converting to h1b ..

If they staffing Agency does not have an MoU with the client, which prohibits your client to hire you directly then you should be fine.

On H1, you work for an employer. The employer can't be a staffing agency.

If the employer is a consulting company, it is still your employer.

his situation is different he is on OPT ..

he is using staffing agency just for his stem extension ( E-verify rule ) ..

he wants to get back to client once he gets his h1b ..
