Petition valid until Nov2014, visa stamping stuck with 221g. New H1B will be transfer or new file?

Hello,

I have H1B petition valid until Nov 2014. But I am stuck due to 221g. Appeared for stamping interview and VO gave 221g asking documents from employer including tax returns. My employer is denying to give those documents. So if I have to look for a new employer will that be a transfer or new petition file?

All are "new" petitions; transfer is only possible if in status in the US and still new petition must be filed.
