Can i Transfer My H1 on 7th Year. I-140 rejected?

Hi my H1 6th year expires on Sep 29 2012.

I applied for GC EB3 PD 2008 Nov. Labor Approved, I-140 Denied and re-appealed on August 2011. Again got the denial letter on August 2012 my lawyer had re-appealed immediately.

Before getting my second I140 denial i got my H1 Extended for another 3 years.

In the mean while My employer is also getting ready to apply for my labor in EB2 again.

My Questions are:

1. Is this valid? When my I140 is denied, my H1 is extended another 3 years.

2. If it is valid... Can i change my employer if i get any full time? Will there be any complications. Or

Should i have to wait till my I140 get approved from my current employer.
