klauz Posted October 5, 2012 Report Share Posted October 5, 2012 My recent H1B got rejected because our client contract did not have a detailed level job description. We had clearly mentioned that my employer defines the duty and not the client but USCIS ignored the statement. Now we are thinking of submitting a new application instead of submitting MTR. Is this a good idea? Also my employer has agreed that I do not have to travel. I can take a senior role which will involve competency and business development. This way I can work entirely from my employer's office and will be able to convince USCIS that my duties are defined by my employer. Any advice? Link to comment

klauz Posted October 6, 2012 Author Report Share Posted October 6, 2012 Thanks cooldude76. I got denial on Sep 30th. What worries me is that same employer is submitting a new application when the first one got denied. We will be extra careful and put a strong case but still.... Link to comment
