H1B Ammendment

Hello,

Our company's attorney filed for my H1B extension in May 2011 since it was due to be expired in June 2011. The case is still pending till date.

Now i want to relocate to another location but the client would be same, and the attorney say's that we need H1B ammendment.Which is completly fine with me.

Since i need to leave out of country in a couple of months i requested my attorney to file H1B ammendment as premium process and they agreed for it . But now the attorney says that i would need my previous H1B case to be approved before they can start the H1B ammendment process.

I was under that impression that H1B ammendment is a brand new H1B process all-together and it is completly independent of the petition filed on my behalf in May 2011.

That is correct, H1 B amendment as the name suggests is an amendment on the original approved pettition or renewal petition in your case. Once the renewal is approved you can file for amendment.
