sairam0208 Posted October 2, 2012 Report Share Posted October 2, 2012 Hi, i need some information, any of the experts please guide me. my h1b visa status is in denial in uscis portal on oct 1 2012. i need some info on below questions: 1) Can i reapply / MTR? 2) what is the avg processing time? 3) I filed under premium will this mtr is considered under premium? 4) what is the success rate? 5) Are my chances gone? kindly help me by providing the above info. Yes, check immediately with an attorney, will depend also on the denial reason 2) what is the avg processing time? Cant say 3) I filed under premium will this mtr is considered under premium? No MTR is not considered under premium 4) what is the success rate? 34% 5) Are my chances gone? No you still have a chance with MTR else if your employer agrees then go for a new H1 Link to comment

If this denial was for new H1 then you need to wait till 2013, if this denial was an H1 extension then you can re-apply and it will be cap exempt. Link to comment
sairam0208 Posted October 5, 2012 Author Report Share Posted October 5, 2012 my employer recieved info about denial it happened on employer-employee relation and also they were asking for some contacts too. Also they requested the past 2 year pay checks. has anyone aware of this? can i get success in mtr for this reason? Link to comment

Swa123 Posted November 14, 2012 Report Share Posted November 14, 2012 Unfortunately MY H1b got denied today as per the USCIS website. Need to wait for alteast one week to get to know the reasons for denial. California center Reg processing H1 to H1 Application recieved by USCIS on june11th RFE on sept15th Responded back to RFE on 25th sept NOv 14th- Denial. Planning to go with MTR after we get to know the reasons for denial Link to comment
