smnpa Posted September 28, 2012 Report Share Posted September 28, 2012 My Employer filed PERM and it went into audit. Including recapture period my end of six years is Feb 01 2013. As I have B1 in my passport, can I change my status to B1 in Feb 2013 in USA till my PERM and I140 approved? I don't have option to change H4. I appreciate your help. Link to comment
JoeF Posted September 30, 2012 Report Share Posted September 30, 2012 A visa in your passport is irrelevant while in the US.A vi sa is an entry document. You can file a COS to B2, but you obviously can not work for your current employer once your H1 expires. Link to comment
