H4 to H1 RFE Response review time VSC. Please Help !

Hi,

Can USCIS take a year to process COS H4 to H1?

COS H4 to H1 applied in Sep 2011 and still waiting for response. Regular processing at VSC

Applied : Sep 13th 2011

RFE: Feb 2nd 2012

RFE Response: Apr 27th 2012

Status still shows RFE Response review. It is year since H4 to H1 COS applied.

Is it a normal situation with the Vermont center?

Attorney called USCIS in Aug and was informed that it is close to decision but have not got any updates till date. Please help me what next I should do. I just cant get any information on what options do I have now .

please advise. It will be really helpful.I am really worried.

You may want to consider upgrading to premium processing if you have not done so already. You may also want to have your attorney contact the Ombudsman’s office, seek congressional help, or lastly file a mandamus case. Please be aware however, with any of the above options, forcing USCIS to adjudicate the petition may cause them to issue a denial for lack of sufficient time to analyze the issue; although, after this delay, even a denial may be welcome by giving you a path forward.
