shubhamk
I am in to situation where my old employer still has my valid H1 , i worked for him for around 9 months . After that i transferred to one big company and now working with them for past 15 months . now i want to get back to old employer who still holds my old H1 and is valid . Is it possible to go back to him with just filling out i91 or i need to file an amendment with USCIS or i just simply go back to my old employer by filing i91 and ammendment if required can be done in later date before travelling out of the country ? shandan
Ok, please explain, how can your previous employer have a valid H1 for you, if it was transfered to another employer ?? Or did you mean to say that the new employer had filed a separate (new) H1 petition for you to for for them. And the old employer has not revoked your old H1. Link to comment
JoeF
When you transferred to another company, the old employer was required by law to cancel the H1 they had for you. Are you telling us that the old employer didn't follow the law? Why would you consider going back to an employer who doesn't follow the law? Link to comment
