sam912 Posted September 23, 2012 Report Share Posted September 23, 2012 My current employer has filed for my L1 extension and I have applied for H1 with COS with another employer. I got RFE on H1 on 17-Sep. And currently my Ref response is under review. My Questions: 1. When should I resign if H1 is approved on 5-Oct which is Friday? 2. Can I resign on Monday 8-Oct? 3. Will I not be able to give any notice to my current employer? 4. What happens if I give 2 weeks notice to current after my H1 is approved on 5-Oct? I am really concerned if my status will be illegal if I am in any of the above situations. Please suggest how one should approach this situation as I do not want to leave my current employer without any notice. Thanks in advance. Link to comment
metroguy Posted September 26, 2012 Report Share Posted September 26, 2012 Dont worry for 1-2 weeks. Make sure you give proper notice to your current employer say 1-2 weeks ahead after your H1B approval, so that he will relieve you properly of your duties and provide you experience certificate, which is needed in your GC process. Then you can join your new company. Link to comment
