Can H1 be extended beyond 6 years?

Hi everyone,

I am in desparate situation and need to find a solution ASAP. So please help me with your answers and suggestions. I very much appreciate your quick replies and suggestions to help me out in this situation. Thanks much in advance.

My current profit H1 visa period is ending on October 2012(finishing 6 years of profit H1). My I-94 is valid till October 10, 2012. I have changed my job to non-profit organization and got non profit H1 approved from Sept 01 2012- Sept 30 2013. During 6 years of profit H1, I have stayed outside US for total period of 5 months with short vacations. If I get another job with profit organization after October 2012, can I use this outside US period(5 months) to apply for profit H1 and get back on profit H1? Also, I have I140 approved on my GC, can I use this approved I140 while applying for profit H1 extension(to get 3 year extension) in the scenario described above to file for profit H1?

any time you have a I140 extension, you can keep using it for 3 year extensions.

My profit H1 validity is till Oct 2012. I had to change this job and now I am

with non-profit organization from Sept 2012. My non profit H1 is valid from

Sept 01, 2012 to Sept 30, 2013. If I change my job after Oct 2012 and go to

another profit company, my 6 year period on profit H1 period is over. In this

scenario,

1. Can I avail earlier profit H1 and apply based on approved I140 even if 6

year H1 period is over? If earlier profit H1 is expiring in Oct 2012, does it loose its validity?

2. Does it need 1 year gap of staying outside US to qualify for profit H1

again? Given an option and if answer to 1st question is yes, then I don't need

to stay outside US for 1 year. Please suggest.
