H1-B 1 year gap rule urgent!!

Hi ,

1st h1-start date april 2008 to expiry date: sep 2010.

Out or usa for 4months during ( april 2008 to expiry date: sep 2010).

1st extension : approved for 3years : expiry date :sep 2013.

Came to india for stamping in april 2011;

stamping status: rejected .

total physical stay in usa: 3.5years.

what are my options now

1Q) if i apply new h1 not against cap count do i get approval for sep 2013 or for 3years

2Q) if i get approval for till sep 2013 .if i get visa can i apply fresh h1 against cap count in april 2013.(as i was out of usa for more than 16months) after while staying in usa.

3)if i apply new h1 no existing h1 if i get approval for till sep 2013 what are my option for further extensions.
