H1 to H4 COS without paystubs

Hi All,

I have paystubs until Apr 2009 after which I went to maternity leave. Due to complications with my delivery I was unable to return to work immediately and then I had other health issues and with the current economic situation I was unable to get a project. My H1B is valid until Dec 2012 and I want to convert to H4. My question is:

1) Can I convert to H4 immediately? My husband's visa also expires in Dec 2012 but he has filed for an extension.

2) I don't have any recent paystubs. What should I do?

3) I am not in a position to travel out of country for stamping since I am pregnant and also have a 2yr old. Can I file for a COS without paystubs?

Need your advice. Please help!

Are you saying that you haven't get paid since 2009???

You are in a lot of trouble. You need to talk with a good lawyer ASAP.
