H1B denial ,Appeal and New visa filling

My H1B visa got rejected.

Below is current situation:

My I-94 expiry date was 7^th Sep 2012.

H1b Visa rejected on 10^th Sep 2012.

My wife‘s visa was not file for new employer (she was on H4 of old employer) hence it also got expired on 7^th Sep 2012 so she is out of status.

1. How long I can live in US?

2. My employer is saying that he will file appeal and then he will file new H1B visa .Can I work with that pending new H1B visa? Or I need to go back and stamp visa again.

3. If my employer only file appeal and don’t file new case and at last I have to leave country after 60 days from the expiry of I-94 what would be the consequence I have to face in airport and specially my wife since her status would be out of status

4. Is there any scenario in which I could be put behind bars?I mean like if I stay more after certain period or work while out of status?
