sam2800
I have been working with a desi company for the last 5 years. They pay salary via direct bank deposit.Recently,I got an offer from a big company and need the last 3 months pay stubs for the H1 transfer. My company had some doubt that I may shift the company and has not been sending me paystubs for the last 2 months ( though they are crediting my salary directly to my bank account every month).I have been following up with them continuously ( by Mail/Phone) for the last 1 month to send me the outstanding paystubs but they are purposely not sending it. In this situation, what option do I have apart from complaining to the DOL? Can I get the H1 transfer done by providing my bank statement which shows salary credit every month? Please help!!! Attorney_10
Generally, most recent paystubs are included with the change of employer H1B petition to demonstrate the beneficiary has been maintaining valid H1B status. In lieu of paystubs, the beneficiary can provide other evidence of payment by the employer, such as evidence of direct deposit into his/her bank account. Link to comment
