My employer had filed for my H1-B with change of status from OPT to H1-B on April 25th this year with a requested start date of October 1st. It is still pending with the USCIS. I am currently working on my OPT STEM extension valid until December 1st, 2012. What will happen if the H1-B is still pending with the USCIS on and after October 1st? Can my employer request the USCIS to postpone the start date of my H1-B to some date after October 1st? Can I continue to work on my OPT STEM extension from October 1st while my H1-B is still pending even though the requested start date of October 1st and change of status date of October 1st would have already passed?
