I am switching jobs from cap-exempt h1b to cap-subject h1b.

My new employer filed my petition in April but I still havent received the approval, yesterday they upgraded my case to premium processing.

I have already announce my resignation at cap-exempt employer and my last day is Sept 30th although my I-94 is valid until June 15th.

So, my question is in worst case scenario if my approval doesnt come in by Sept 30th, will I go out of status or will have some grace period based on pending h1b approval and valid I-94?

IMO it would better to get the approval..then file a transfer with the new employer..after you get the reicept you could have announced your resignation

You can start working for the new employer based on the H1 receipt notice.

Based on your response, can I work based on just receipt notice because I am switching from cap-exempt to cap-subject?
