nupuraggarwal Posted September 13, 2012 Report Share Posted September 13, 2012 I am switching jobs from cap-exempt h1b to cap-subject h1b. My new employer filed my petition in April but I still havent received the approval, yesterday they upgraded my case to premium processing. I have already announce my resignation at cap-exempt employer and my last day is Sept 30th although my I-94 is valid until June 15th. So, my question is in worst case scenario if my approval doesnt come in by Sept 30th, will I go out of status or will have some grace period based on pending h1b approval and valid I-94?
