I-94 Status question on H1B

Hi All,

I am on H1B visa and below is the summary of my H1B visa and passport:

1. I am currently on H1B with I-797 valid till Feb. 2014 through my curent employer (I-797 approved in June 2012).

2. I have the H1B visa endorsed in my passport through my previous employer valid till Nov. 2013.

3. My passport expires in June 2013.

I recently (Sep. 2012) travelled to Dominican Republic for a week on vacation and re entered USA. However, the admitting officer at the port of entry has issued a new I-94 till June 2013 (expiry of passport) instead of Feb. 2014 (validity of I-797).

Assuming that I get my passport renewed within a month or two, should I travel out of country after June 2013 (I-94 validity) and re enter USA with a new I-94? Will I be out of status after June 2013 eventhough the I-797 is valid till Feb. 2014?

Yes, make sure to submit new I-797 at POE to get a new I-94 with extended period.

Will I be out of status after June 2013 even though the I-797 is valid till Feb. 2014?

You will be out of status if you don't get the I-94 extended
