L1 to H1 COS

Hi, I am on L1 in a indian consultancy firm and currently have I94 till May 2015 with visa expired. Company B has filed for H1B with COS and its approved with start date of 1st Oct.

I am not planning to join the company B as I have heard really bad things abt them. What are my options, I don't want to go for L1 stamping.

I have canadian business visa and have a business trip scheduled in last week of Sep, I can extend the trip by few days to come back after 1st Oct. If I use Automatic Revalidation rule for less than 30 days travel, will my status will be changed back to L1.

I have no idea about Automatic Re-validation rule and wait for experts advice on that. Since you are already going out of Country to Canada, I suggest you to get L1B stamped there itself if it is allowed and come back.

If ARR doesn't work then your L1B employer needs to apply COS from H1-L1. That is the only option you have if you don't want to get L1B stamped and come back. Please check with your employer or attorney regarding that.
