kishankakarla Posted September 6, 2012 Report Share Posted September 6, 2012 I was with employer A and I got a 140 through him and got a 3 year extension on my H1 based on it during my 6th year. Now, I moved to employer B but I got only year extension with this employer when I moved. At present, I am in my 7th year of H1 and only 8 months left on it. We are about to start the GC process. I am quite worried as there is not enough time for me to get a 140 to file another extension. So, my question is, since I have a 140 from my previous employer which is valid till 2015, can I get an extension based on it if even if i dont get a PERM or 140 with the new employer within the 8 months? I heard that if I my old employer does not revoke the i140, I should be fine. Is that true? Link to comment
luck2u Posted September 20, 2012 Report Share Posted September 20, 2012 Yes, until your employer A doesn't revoke I-140 you can get H1B extension with employer B even your PERM is pending for more than 8 months from now. Link to comment
