sash.murthy Posted September 5, 2012 Report Share Posted September 5, 2012 My 6th year H1B is expiring on Feb 2012 and also have LC approval which is expiring on Oct 2011. My current employer has issues or not willing to file I140. In this case, 1. Can I transfer my H1B to a different employer using the current LC approval and get an extension for 1.6 years (Sep 2011 - Feb 2012 + 1 year)? or 2. Will I get an extension only for the remaining period? Thanks Link to comment

luck2u Posted September 20, 2012 Report Share Posted September 20, 2012 As per my understanding LC means PERM approval, you cannot get 1 year extension with PERM from different employer when you apply for H1B transfer. H1B will be approved upto 6 years maximum period when applied for transfer if you don't have I-140 approval. Link to comment
